Website Terms of Use

The general terms that govern your use of rakyourlife.com, our newsletter, our podcast, the free guides and resources we offer, and our events and community memberships. The wellness app at app.rakyourlife.com is governed by a separate set of terms.

1. Your agreement

These Terms of Use ("Terms") are a binding agreement between you and Rakesh Jotwani, MD, PC ("we," "us," "RAK Your Life"), a California professional corporation. By using rakyourlife.com or any of the services described below, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the site.

2. What these Terms cover

These Terms apply to your use of:

• The website at rakyourlife.com and its subdomains, except as noted below
• Our newsletters (RAK ON, Friday Feast) and other email communications
• Free guides and lead magnets we offer (such as the Sauce Library, recipe booklets, and other downloadable resources)
• The Health Feast podcast and any companion show notes or transcripts hosted on the site
• Events and courses we run (such as Mindful Meals cook-alongs, Men's Peak Tribe sessions, and live workshops)
• Community memberships we operate (such as the RAK ON Tribe)

3. Who can use the site

You may use the site if you are 18 years of age or older and able to enter into a binding contract under the laws of your jurisdiction. The site is not directed to children under 18 and we do not knowingly collect their personal information.

You are responsible for ensuring that your use of the site is legal where you are.

4. Newsletter, lead magnets & email

When you subscribe to a newsletter, request a free guide, or otherwise share your email with us, you agree that we may send you:

• The content you requested (newsletter issues, downloadable guides, event details)
• Occasional updates about Dr. Rak's work, programs, podcast, and offerings
• Transactional emails (account confirmations, receipts, event reminders) when applicable

You can unsubscribe from marketing email at any time using the link in the footer of any email or by emailing support@rakyourlife.com. Transactional emails will continue while you are an active subscriber, patient, or member.

Free guides and downloadable content we provide are for your personal, non-commercial use. See Intellectual property.

5. Events, courses & community memberships

When you register for an event, enroll in a course, or join a paid membership (such as the RAK ON Tribe or Men's Peak Tribe), the following additional terms may apply:

• Fees and billing. Prices, billing frequency, and cancellation rules are described on the relevant signup page at the time of purchase. Payments are processed by Stripe or the platform hosting the offering (such as Circle).
• Automatic renewal. Memberships that renew automatically (such as monthly or annual subscriptions to the RAK ON Tribe) will continue at the rate, frequency, and on the schedule disclosed at the time of purchase, and will renew until you cancel. You may cancel at any time through the platform's account settings or by emailing support@rakyourlife.com; cancellation takes effect at the end of the then-current billing period unless we agree otherwise. You will receive an electronic acknowledgment of the renewal terms at purchase and reasonable advance reminders of renewal where required by California's Automatic Purchase Renewals Law and similar state laws.
• Refunds. If you cancel a paid membership, you generally remain entitled to access through the end of the billing period you have already paid for, but we do not pro-rate refunds for unused time except where required by law. For events, courses, and one-time purchases, refund eligibility is described on the relevant signup page. Outside any stated policy, we consider refund requests in good faith and on a case-by-case basis. Nothing in this section limits any non-waivable refund or cancellation rights you have under California Civil Code §§ 1689.5–1689.14 (the Home Solicitation Sales Act), the Automatic Purchase Renewals Law, or other applicable consumer protection law.
• Code of conduct. Live events and community spaces are governed by a code of conduct grounded in respect, confidentiality, and the RAK framework (Roots, Awareness, Kindness). We may remove anyone who harasses, threatens, or harms other members.
• Confidentiality among members. Members agree to treat what other members share in community spaces as confidential, not to record or screenshot other members' contributions, and not to share other members' personal stories or identifying information outside the community without that member's explicit consent. We do not guarantee that other members will honor this expectation; you should share only what you are comfortable having shared.
• Recordings, photos, and your release. We may record, photograph, livestream, or transcribe sessions, events, and live community calls for educational, promotional, or operational purposes. Where we record, we will tell you in advance. By participating in a recorded session, you grant us a worldwide, perpetual, royalty-free, sublicensable license to use, edit, reproduce, distribute, and publish the recording (including your image, voice, name, and any contributions you make on the recording) in our content, marketing, podcast, courses, and educational materials. You may request that we remove your contributions from any future use by emailing support@rakyourlife.com; we will use reasonable efforts to comply for prospective uses, though we cannot recall recordings already distributed.
• Peer-support communities are not recorded. Our peer-support communities, including the Men's Peak Tribe, are not recorded, photographed, livestreamed, or transcribed. Sessions are held with the understanding that what happens in the room stays in the room. If, in the future, we propose to record a specific peer-support session (for example, an educational segment), we will require advance, opt-in written consent from every participant for that specific session; the release in the previous bullet does not apply to peer-support communities by default. Membership in any community we run is a privilege, not a right. We may suspend or terminate membership for conduct that harms the group or violates these Terms, with or without refund depending on the circumstances.

6. Podcast and editorial content

The Health Feast podcast, the RAK ON and Friday Feast newsletters, blog posts on the site, and other editorial content reflect the views of Dr. Jotwani and any guests at the time of publication. Guest views are their own and do not necessarily reflect ours.

Content may be shared, linked, and quoted briefly with attribution (author, title, link to the source). Full reproduction, republication, or commercial use of content requires written permission.

7. Acceptable use & enforcement

When using the site, the newsletter, or any of our communities, you agree not to:

• Use the site for any illegal purpose or to harm yourself or others
• Impersonate another person, misrepresent your identity, or use someone else's email or payment information
• Harass, threaten, or harm other members of our communities
• Submit content you do not have the right to share, including other people's private health information
• Scrape, crawl, or otherwise extract content at scale
• Reverse engineer, decompile, or attempt to extract source code from our site or app
• Use the site to send unsolicited commercial messages, spam, or chain communications
• Interfere with the security of the site, attempt unauthorized access, or circumvent rate limits or other technical controls
• Resell, sublicense, or share access to paid memberships, courses, or events without our permission

Our enforcement rights

We reserve the right, at our sole discretion and with or without prior notice, to:

• Remove, redact, or refuse any content submitted to the site or any community space
• Suspend, restrict, or terminate any account, membership, registration, or subscription
• Escalate threats of harm to law enforcement, emergency services, or other appropriate authorities
• Disclose account information, content, and metadata to law enforcement, emergency services, regulators, or others where we believe in good faith that disclosure is necessary to protect the life or safety of any person, to comply with law, to enforce these Terms, or to investigate suspected violations
• Preserve content, account records, and metadata for legal, safety, or compliance purposes, including pending or anticipated litigation holds
• Refuse service to any user for any lawful reason

These rights are in addition to, and not in place of, the other rights we have under these Terms, applicable law, and our Privacy Policy. Exercising one right does not waive any other. We may pursue available legal remedies for violations of this section.

Reporting misconduct

If you witness conduct in any of our community spaces that you believe violates these Terms, including harassment, threats, sharing of someone else's private health information, or attempts to extract clinical advice from non-clinicians, you may report it to support@rakyourlife.com. You may report anonymously. We will not retaliate against good-faith reporters, and we will not disclose the identity of a reporter except where disclosure is necessary to investigate, to comply with law, or to protect the life or safety of any person.

8. Intellectual property & content license

The website, the RAK Your Life name and logo, the "fist" mark, the RAK framework, our written content, our voice meditations, our recipe guides and Mindful Meals materials, our newsletters, and our podcast are owned by Rakesh Jotwani, MD, PC, and protected by US and international intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Read, view, and listen to content on the site for your personal, non-commercial use
• Download free guides and lead magnets for your personal, non-commercial use
• Share short quotes or excerpts with attribution and a link back to the original

This license does not give you the right to copy, modify, distribute, resell, sublicense, reverse engineer, or build a competing product or service from our content or brand assets. Don't run our guides, recipes, or framework materials as your own program or course without written permission.

If you submit content to us (such as testimonials, story submissions, podcast voicemails, community posts, or social tags), you grant us a worldwide, non-exclusive, royalty-free license to use that content to operate, promote, and improve our work, with attribution where appropriate. You can withdraw this license for future uses by emailing support@rakyourlife.com.

9. Third-party services, links & payment processors

The site links to and integrates with services operated by other companies, including:

• Kit for newsletter delivery, lead-magnet delivery, and email automation
• Calendly for scheduling consults, discovery calls, and events
• Circle for the RAK ON Tribe community and membership checkout
• Stripe for payment processing
• Substack for newsletter archives
• YouTube, Spotify, Apple Podcasts for podcast distribution
• JotForm for intake and application forms

Your use of these services is governed by their own terms and privacy policies. We are not responsible for their content, availability, or practices.

The site may also link to articles, studies, and resources on third-party websites for reference. We are not responsible for the content on those sites.

10. Medical & wellness disclaimer

If you are a clinical patient of Dr. Jotwani, your clinical care is governed by your patient agreement and our HIPAA Notice of Privacy Practices, not by these Terms. PHI shared in clinical channels is governed by HIPAA.

11. No warranties

THE SITE AND ALL CONTENT, NEWSLETTERS, GUIDES, PODCASTS, EVENTS, COURSES, AND COMMUNITIES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND TITLE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR YOUR CIRCUMSTANCES.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RAKESH JOTWANI, MD, PC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY OF THE SERVICES COVERED BY THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) US $100.

Some jurisdictions do not allow certain limitations of liability; in those places, the limitations apply only to the extent permitted by law. Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, intentional misconduct, or, where applicable, personal injury.

13. Indemnification

You agree to defend, indemnify, and hold harmless Rakesh Jotwani, MD, PC, its officers, employees, agents, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the site or any service covered by these Terms, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) content you submit to us or share in our community spaces.

14. Changes to the site or these Terms

We may add, change, or remove parts of the site, the newsletter, our events, or our community offerings at any time. We may also revise these Terms. When we make material changes, we will update the Effective Date at the top, increment the version, and (for newsletter subscribers and members) notify you by email before the change takes effect. The current version is always available at this URL. Continued use after a change means you accept the updated Terms.

15. Termination of access

You may stop using the site or unsubscribe from any service at any time. We may suspend or terminate your access to the site, the newsletter, an event, a course, or a community immediately and without notice if you violate these Terms, abuse the service, harm other members, or if we are required to do so by law.

Sections that by their nature should survive termination (intellectual property, disclaimers, no warranties, limitation of liability, indemnification, dispute resolution, general terms) will survive.

16. Disputes, arbitration & class waiver

Informal resolution first. Before filing any formal dispute, please email support@rakyourlife.com with a description of the issue. We'll try to resolve it within 30 days.

Binding arbitration. If we can't resolve the dispute informally, any controversy or claim arising out of or relating to these Terms or your use of the site, except claims that may be brought in small-claims court, and except claims for injunctive or other equitable relief, will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted by a single arbitrator. The location will be San Mateo County, California or, at your election, virtually. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You agree that disputes will be resolved on an individual basis. You and we both waive any right to participate in a class action, collective action, consolidated proceeding, or representative proceeding. If this waiver is held unenforceable, the entire arbitration section becomes null and void.

Carve-outs. Nothing in this section prevents you from filing a complaint with any state or federal agency, including a state medical board or HHS Office for Civil Rights. Claims for personal injury arising out of clinical care fall outside this arbitration provision and are governed by applicable state law and any separate patient agreement you signed.

17. Governing law & venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Except for matters subject to arbitration above, you and we consent to the exclusive jurisdiction of the state and federal courts located in San Mateo County, California.

18. General terms

• Entire agreement. These Terms, together with the Privacy Policy, any additional terms for a specific service (such as the RAK AI & App Terms or a course or membership agreement), and the Medical & Wellness Disclaimer, are the entire agreement between you and us about the matters they cover.
• Severability. If any provision is found unenforceable, the rest stays in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You can't assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure. Neither party is liable for failure to perform caused by events outside our reasonable control.
• Notices. We may give notice to you by email or by posting on the site. You give notice to us by emailing support@rakyourlife.com or legal@rakyourlife.com.
• Independent contractors. Nothing in these Terms creates a partnership, joint venture, or employment relationship.
